Lawyers of the State Inspector’s Service Underwent a Training on the Topic of Administrative Offenses
2021-10-13 17:12:14The aim of the training was to discuss the procedures of administrative proceedings on the facts of possible illegal processing of personal data, to solve practical issues raised in the daily activities of the Service and to get acquainted with the court case law in this regard.
The training was opened by the Deputy State Inspector - Sophio Jiadze, the Ambassador Extraordinary and Plenipotentiary of the Kingdom of the Netherlands in Georgia - Maike Van Koldam and the Director of the Institute for Development of Freedom of Information (IDFI) - Giorgi Kldiashvili.
The training was led by Judge Shota Getsadze of the Tbilisi Court of Appeals and former judge of the Constitutional Court of Georgia, lecturer Maia Kopaleishvili.
The involvement of practising judges in the training process was of particular importance in order to address the legislative and practical challenges in the work of the Service and to increase the effectiveness of the future work of the Service.
The following important issues were discussed in the course of the training: the burden and standard of proof in the administrative proceedings; circumstances to be taken into account when imposing administrative fines on the fact of unlawful processing of personal data by the Service and expunging of liability and foreseeability of the norms of administrative offences; challenges related to the limitation period; Judicial control over decisions made by the State Inspector's Service.
The training was conducted within the framework of the project "Promoting Personal Data Protection in Georgia" in cooperation with the Institute for Development of Freedom of Information (IDFI) and with the financial support of the Embassy of the Kingdom of the Netherlands in Georgia.
